These terms apply to all contracts for the use of the “Lern Up Coach” between Sanvi Sodji, trading as Lern Up Academy, Nienburger Str. 2, 28205 Bremen, Germany, email info@lernupacademy.de (“we”, “us”), and our customers (“you”). Deviating terms only apply if we expressly agree to them.
The Lern Up Coach is a talking AI practice partner (software). On the German website it is offered for the subjects mathematics, German, English and French for school years 5 to 13. On the English website (www.lernupacademy.de/en) it is offered for learning the languages French and German at levels A1 to B2; school years and school subjects do not apply there. The coach is used in the browser and includes voice conversations, a written chat mode, worksheets, uploading homework or other learning material as a photo or PDF, a quiz after the session and, on the German website, a written summary by email to the address given at sign-up.
The coach is an AI, not a teacher. The content is generated automatically and may occasionally be incorrect. We do not owe any particular learning outcome, improvement in grades, language level or the passing of exams.
What is used up is the actual conversation time with the coach, measured from establishing the connection to the end of the conversation. Unused minutes of a billing month expire at its end and are neither carried over nor refunded; unused minutes of a single session expire after 30 days. Once the minutes are used up, the coach cannot be started until the next billing month; additional minutes can be bought at any time as a single session. There is no automatic additional charge.
For the written chat with the coach, billing works as follows instead of conversation time: starting a chat deducts 1 minute from the minute balance, and after that every 10 messages sent by the customer (including uploaded photos or files) deduct 1 further minute. If there are not enough minutes left, the chat ends.
When taking out a 6-month plan, the customer receives 50 additional minutes once in the first billing month, and 100 additional minutes with the 12-month plan (welcome bonus). Bonus minutes are only valid in the first billing month, expire at its end, are not transferable and are not paid out or refunded. The welcome bonus lapses in the event of withdrawal or refund.
The free trial (5 minutes; on the German website in the subject French, on the English website for French or German; once per email address, device and internet connection) does not create any obligation to pay. Anyone who reaches the stated goal in a learning game on this website (German or English pages) can instead use 10 minutes of speaking once in a subject or language of their choice offered on the respective pages; the same restrictions apply, there is no entitlement to this promotion and it may be ended at any time.
The presentation of the plans on the website is not a binding offer. You sign up with your email address, choose a plan and submit a binding offer by clicking the order button in the checkout. The contract is concluded when the payment has been authorised and we activate access; you receive confirmation by email.
For children and young people under 18, the parents or legal guardians conclude the contract and sign up with their own email address.
The offer on the English website is currently directed exclusively at customers whose habitual residence is in a member state of the European Union. If a contract is nevertheless concluded with a customer resident outside the EU, we may cancel it; in that case we refund all payments received in full without undue delay and access ends.
All prices are final prices. As a small business within the meaning of § 19 of the German VAT Act (UStG), we do not charge or show VAT. Payment is processed by the payment service provider Stripe (Stripe Payments Europe Ltd., Ireland) by credit or debit card, Apple Pay, Google Pay, SEPA Direct Debit, PayPal or Klarna. If you choose PayPal or Klarna, their terms of use also apply; Klarna may carry out its own identity and credit check and decline the payment. The monthly plan and the 6- and 12-month plans are charged monthly at the beginning of each billing month for that month; the single session is paid on purchase. You receive a payment receipt by email.
If a payment due cannot be collected (e.g. a returned direct debit), the payment service provider will try again and we will inform you by email. Until the amount is settled, we may block access; your obligation to pay the agreed monthly amounts remains unaffected. If you are in default with two consecutive monthly payments, we may terminate the contract extraordinarily for good cause; further statutory claims remain unaffected. You may have to reimburse us for return debit or chargeback fees caused by you.
You can cancel at any time online via “Cancel your contract” or by email to info@lernupacademy.de. The right to extraordinary termination for good cause remains unaffected. When the contract ends, access ends; periods already paid for remain usable until they end.
Access is personal and may not be passed on to third parties or used simultaneously on several devices by different people. You only upload content you are entitled to use and do not photograph names, addresses or faces of third parties. Misuse (e.g. automated requests, circumventing the trial, unlawful content) entitles us to block access.
We strive for the most uninterrupted availability possible but do not owe any particular availability. Maintenance, disruptions at service providers (e.g. speech or AI services) or internet connections may temporarily restrict use. Minutes lost due to an interruption for which we are responsible will be credited on request.
We are liable without limitation for intent and gross negligence, for injury to life, body and health and under the German Product Liability Act. In the case of simple negligence, we are only liable for breach of an essential contractual obligation whose fulfilment makes the proper performance of the contract possible in the first place, and limited to the foreseeable damage typical for the contract. Otherwise, we accept no liability for the accuracy of automatically generated explanations, worksheets, quiz questions and feedback.
Consumers have a statutory right of withdrawal. Details can be found in the withdrawal policy.
Information on the processing of personal data can be found in the privacy policy.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the law of the state of their habitual residence. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. In case of doubt or contradiction, the German version of these terms prevails.
